255. Examination of accused.
(1) After the witnesses for the prosecution have been examined and the accused has been examined under section 346, the Judge shall, if he considers that there is no evidence that the accused committed the offence, record an order of acquittal.
(2) If the Judge does not record an order of acquittal under sub-section (1), he shall, after the examination of the accused, hear the prosecution and the defence on the point whether the accused has any defence to make and, if the accused has a defence to make, proceed to take all such evidence as may be produced in support of the defence.
