361. Procedure in cases which Magistrate cannot dispose of.
If, in the course of a trial before a Magistrate, it appears to him at any stage of the proceedings before signing judgment that the case is one which ought to be tried by the Court of Session or the Chief Judicial Magistrate, he shall transfer the case to such Court, and thereupon the provisions of this Sanhita shall apply as if such Court had taken cognizance of the offence.
