477. Procedure for exercise of power of suspension or remission.
The appropriate Government, before exercising its powers under section 473, shall consider—
- the opinion of the presiding Judge of the Court before or by which the conviction was had or confirmed as to whether the application should be granted or refused, together with his reasons for such opinion;
- the nature and gravity of the offence;
- the relevant circumstances, including the condition of the victim;
- whether a minimum sentence has been imposed by the Court;
- the circumstances which are special to the convict.
