509. Non-compliance with provisions of section 183 or section 316.

If any Criminal Court before which a prosecution is conducted finds that any provisions of section 183 or section 316 have not been complied with, it shall not set aside the proceedings merely on the ground of such non-compliance, unless such non-compliance has in fact occasioned a failure of justice.
