(1)
The Chairman and other members of the Board shall be appointed for such period not exceeding five years as the Central Government may in each case deems fit:
Provided that the Chairman and the [other member shall not hold office] [Substituted by Notification No. G.S.R. 788(E), dated 10.8.2016 (w.e.f. 14.3.2013).] as such after he has attained,-

The Chairman and other members of the Board shall, on the expiry of the period of their appointment, be eligible for re-appointment.

The Chairman or any other member of the Board may resign his office by giving three months' notice in writing to the Central Government:
Provided that the Chairman or any other member shall, unless he is permitted by the Central Government to relinquish his office sooner, continue to hold office until the expiry.

The Chairman or any other member shall not be removed from his office except by an order made by the Central Government on the ground of proved misbehaviour or incapacity after an enquiry made by a Judge of the Supreme Court in which the Chairman or the other member had been informed of the charges against him and given a reasonable opportunity of being heard in respect of those charges.
